Acceptable Use Policy
1. Scope
This Acceptable Use Policy (“AUP”) applies to everyone who uses Liles Automation's Services, including Atlas. It is incorporated into our Terms of Service and your Master Services Agreement. We may update it as laws and platform rules evolve.
2. You are the sender of record
When Atlas sends a text, email, or voice message to your leads or customers, you are the party legally responsible for that message under applicable law. We provide the tooling and safeguards; you provide the contacts, the consent, and the underlying relationship. You represent and warrant that you have the legal right to contact every person you load into or message through the Services.
3. Messaging consent & compliance (TCPA, CAN-SPAM, and similar laws)
You agree that, for all messages sent through the Services, you will:
- Have the required consent. Obtain and keep records of the prior express consent that the law requires before sending calls or texts — including, where applicable, prior express written consent for marketing messages under the Telephone Consumer Protection Act (TCPA).
- Honor opt-outs immediately. Stop messaging anyone who replies STOP, unsubscribe, or otherwise asks to opt out. Atlas honors STOP automatically and maintains a blocklist, but you must not attempt to circumvent it or re-add opted-out contacts.
- Respect Do-Not-Call and quiet hours. Scrub against do-not-call obligations that apply to you and avoid messaging outside legally permitted hours.
- Follow CAN-SPAM for email. Use accurate “from” and subject lines, identify the message's nature, include a valid physical postal address, and provide a working unsubscribe that you honor promptly.
- Identify yourself. Make clear that messages come from your business.
You are solely responsible for your consent records and compliance. We are not your compliance advisor; if you are unsure whether you may contact someone, do not contact them until you have confirmed you may.
4. Prohibited content & conduct
You may not use the Services to:
- Send messages to people who have not consented or who have opted out, or buy/scrape lists you have no relationship with and blast them.
- Send unlawful, deceptive, harassing, hateful, or fraudulent content, or content you have no right to send.
- Impersonate any person or business, or misrepresent your identity or affiliation.
- Transmit malware, attempt to breach security, probe, or disrupt the Services or others' systems.
- Send regulated content you are not authorized to send (e.g., certain financial, health, or adult content).
- Reverse-engineer, resell, or build a competing service from the Services.
- Use the Services in a way that could cause our messaging providers to suspend or penalize our accounts.
5. Data you provide
You must have the right to share any contact and customer data you load into the Services, and you must handle it in line with our Data Processing Addendum. Do not upload special-category or payment-card data unless your SOW expressly provides for it.
6. Enforcement
If we believe you are violating this AUP, we may — with or without notice depending on severity — pause specific messaging, suspend the Services, or terminate the engagement. We will try to give notice and a chance to cure where the violation is minor and curable. We may also act immediately to protect recipients, our providers, or third parties.
7. Your indemnity
You agree to defend and indemnify Liles Automation against claims, fines, and penalties arising from your violation of this AUP or of messaging laws, including the TCPA and CAN-SPAM Act, as set out in the Terms and MSA.
